Student letting arrangements need careful timing. Ground 4A is a specific possession route, not an automatic end date for every student tenancy. This guide was reviewed on 15 October 2026 and concerns England.
Check Ground 4A eligibility
Government guidance describes the ordinary route for an HMO let to full-time students that is required for another student group within the academic-year window of 1 June to 30 September. Prior notice is required, and the ordinary notice period is four months. A tenancy agreed more than six months before it starts does not qualify under the ordinary rule.
Existing tenancies have transitional provisions, including specific exceptions in Schedule 6 of the Renters’ Rights Act. The temporary two-month notice arrangement for summer 2026 required a possession notice between 1 May and 30 July 2026. That window has passed. Check which rules govern the actual agreement before serving anything.
Keep payment and guarantee questions separate
The Act restricts rent required between signing and the start of the tenancy to the first rent period: one month, or up to 28 days for shorter rental periods. Do not use a large advance-payment request as a substitute for checking the applicable rules.
A guarantor’s responsibility depends on the guarantee wording and how it was entered into. Do not assume a parent automatically guarantees every housemate’s debt. Make the documents and proposed liability clear before signature and obtain specialist advice where necessary.
Keep a tenancy timeline
Record the agreement date, occupation date, student evidence and prior notice. Keep proof of delivery and use the current possession guidance. A notice is part of a legal process; it does not authorise a landlord to remove occupiers personally.
