Student funding and rent schedules do not always fall on the same dates. That practical difficulty needs a lawful payment arrangement, rather than an assumption that a landlord can demand a whole term or year upfront. This archive article was reviewed on 16 October 2026 against the current English guidance.
Check when the agreement was signed
The government’s rent-in-advance guidance applies to private assured periodic tenancies, with important exclusions for agreements signed and advance payments made before 1 May 2026. It also prohibits landlords or agents from asking for, encouraging or accepting rent before the agreement is signed by both sides.
Establish the relevant dates before applying a general explanation to an existing student letting. Keep the signed agreement and payment history together. Do not describe money as something else simply to avoid checking the rules that govern its actual purpose.
Separate the funding problem from the legal question
Ask the student to explain the expected funding schedule without collecting unnecessary personal information. Identify the payment dates in the agreement and the point where a practical shortfall might arise. Then obtain advice on a compliant arrangement rather than improvising an advance-payment demand.
Where a guarantor is proposed, have the wording and intended liability reviewed separately. A guarantor is not a substitute for understanding the tenancy or the payment rules. Explain any proposed arrangement clearly so nobody relies on an informal assurance that conflicts with the documents.
Keep a transparent payment record
For every payment, record the amount, date and period it covers. Distinguish rent from a protected deposit or other permitted payment. Provide a clear explanation when a payment is allocated or corrected, and keep the earlier record visible.
If there is uncertainty about money already paid, obtain housing advice before withholding further rent, demanding extra sums or making deductions. The useful outcome is a payment schedule the parties understand and can verify against the applicable rules, not a workaround based on an old student-letting custom.
