Scottish landlords reviewing old rent-control headlines need to distinguish three things: the legislation, the assessment of local rents and a designation that applies controls to an area. A political announcement is not, on its own, a property-specific rent instruction.
The assessment stage
The Scottish Government explains that the Housing (Scotland) Act 2025 provides for long-term controls where justified. Local authorities began their assessment duties on 1 April 2026, with their first reports due by 31 May 2027. Those reports inform decisions by Scottish Ministers; consultation and a designation are separate steps.
The government describes a cap for applicable private residential tenancies in designated areas of inflation measured by CPI plus one percentage point, subject to a six per cent maximum. Exceptions and exemptions also matter. Do not apply that formula to a particular letting without checking whether the area, property and relevant provisions are covered.
Other reforms have their own dates
The Scottish Government’s tenant-rights page sets out a separate timetable. From 1 April 2027, tenants will have up to 30 days to request a rent review, and a rent officer or tribunal will not be able to set a rent above the landlord’s proposed increase.
The same page says commencement dates have not yet been set for the new pet-request and home-personalisation provisions. Their appearance in the Act therefore does not mean every new process is already operational. This distinction is especially important when updating letting documents or answering a tenant’s request.
A practical record for each property
Keep the tenancy type, current rent, last increase date and relevant notices together. When reviewing an official update, record the source and the date checked, then note whether it concerns a proposal, a commenced provision or a local designation. This gives an agent and owner a shared basis for decisions.
For a new investment, ask for the tenancy paperwork rather than assuming vacant possession or a change of tenant removes every restriction. Obtain Scottish housing advice where coverage is unclear. This is a guide to checking the framework, not a calculation of the rent that a particular landlord may charge.
